Becoming a Franchisee

Franchisee Legal Services.png

The process of becoming a franchisee can be daunting, and many would-be franchisees simply have no experience with the franchise purchase process. The attorneys at Rauchway Law routinely walk clients through each step of buying a franchise.

Often, a client will contact our office having just been handed a thick Franchise Disclosure Document (an “FDD”) and proposed Franchise Agreement - a mountain of paperwork for anyone, let alone an entrepreneur starting a new business venture.  We pride ourselves in putting our clients’ minds at ease by explaining what is in the FDD and the proposed Franchise Agreement, identifying any red flags we see from a legal perspective, and reviewing possible items to negotiate in the Franchise Agreement based on our client’s goals and objectives.  Critically, we will offer strategic advice, specifically customized to the unique circumstances of the franchise deal in question, as well as guidance on common practices in the industry.  We will then zealously (yet respectfully) advocate for our client’s position with the Franchisor, while being mindful, every step of the way, of the importance of a good relationship between franchisee and franchisor.

We are fortunate to assist many new franchisees on their journey to franchise ownership.  In addition to counseling single-unit franchisees through the purchase process, the lawyers at Rauchway Law handle Multi-Unit and Area Developer Agreements, commercial leases negotiations and formation of Franchisee companies.
